The U.S. Supreme Court has granted a one-month extension to the U.S. Solicitor General for a decision on whether to seek a review of the FCC’s “fleeting profanity” case against Fox.
At issue is whether to ask the high court to review a federal appellate decision finding that the FCC was not justified in banning profanity on the airwaves. Under federal law, the Solicitor General must make such a decision.
The new deadline for a decision is Oct. 4. Some legal experts see such an appeal as risky for the FCC, because the Supreme Court could strip the commission of all its power to regulate broadcast content.
